Terms & Conditions

Applicability

These general terms and conditions apply to all offers, quotations, assignments, and agreements entered into between Viktoria Jensen Photography (KvK number 97953296, Boekweitstraat 21, the Netherlands) and any client, insofar as the parties have not explicitly deviated from these terms in writing.

By accepting a quotation, signing a booking confirmation, or making a reservation payment, the client confirms that they have read, understood, and agreed to these terms and conditions in full.

Any deviations from these terms are only valid if agreed explicitly and in writing by both parties. General purchasing conditions or other terms used by the client do not apply.

Services

Viktoria Jensen Photography provides professional photography services including, but not limited to:

  • Wedding and elopement photography
  • Couple and engagement photography
  • Maternity and newborn portrait sessions
  • Family and lifestyle portrait sessions
  • Commercial and brand photography

The specific scope of services, including session duration, location, number of edited images, and any additional deliverables, is set out in the booking confirmation or written quotation provided to the client.

Viktoria Jensen Photography reserves the right to decline any assignment at her sole discretion.

Pricing and Payment

All prices are stated in euros and include VAT unless explicitly stated otherwise. Prices are subject to change; the price applicable at the time of booking confirmation applies to the relevant assignment.

Reservation fee. Upon signing the booking confirmation, a non-refundable reservation fee of 30% of the total agreed amount is due. This fee secures the date and is deducted from the total invoice. No date is reserved until this payment has been received.

Balance payment. The remaining balance must be received no later than 14 days prior to the session or event date.

Commercial assignments. For commercial photography, the full invoice amount is due within 14 days of the invoice date.

In the event of non-payment by the due date, Viktoria Jensen Photography reserves the right to cancel the booking. Statutory interest (wettelijke rente) and reasonable collection costs may be charged on overdue amounts.

Additional Work

Work that falls outside the agreed scope — including but not limited to extended session time, additional editing, return visits, or significant travel beyond agreed parameters — constitutes additional work and will be charged separately.

Additional work will only be carried out following explicit written approval from the client. The applicable rate for additional work will be communicated in advance.

Cancellation and Rescheduling

All cancellations must be submitted in writing to info@viktoriajensen.nl. The reservation fee is non-refundable in all circumstances.

In the event of cancellation by the client, the following conditions apply:

More than 30 days before
Only the reservation fee is forfeited. No further amounts are due.
8 – 30 days before
75% of the total agreed amount is due.
Within 7 days
100% of the total agreed amount is due.

Cancellation by the photographer. In the event of cancellation by Viktoria Jensen Photography due to illness, accident, or force majeure, the client will be offered a suitable alternative date. If no alternative can be agreed, the client will receive a full refund of all amounts paid, including the reservation fee.

Rescheduling. One rescheduling per booking is permitted without additional charge, subject to availability, provided the request is received in writing at least 14 days before the original session date. Further rescheduling will be assessed on a case-by-case basis.

Delivery and Retention Period

Edited photographs are delivered digitally via a private, password-protected online gallery within the following indicative timeframes after the session or event date:

Portrait sessions
2 – 3 weeks
Wedding photography
4 – 6 weeks
Commercial assignments
As agreed in writing

The number of edited photographs delivered is at the professional discretion of Viktoria Jensen Photography. The selection reflects the quality standards and artistic vision of the studio.

RAW files. Unedited RAW files are not delivered under any circumstances. This is not negotiable.

File retention. Delivered photographs are retained by Viktoria Jensen Photography for a period of six months after delivery. After this period, the photographer has no obligation to retain or re-deliver the files. Clients are strongly advised to download and create personal backups of their gallery within the delivery period.

Artistic Freedom

Viktoria Jensen Photography works with a distinctive editorial aesthetic and personal vision. The photographer's creative approach — including image composition, selection, post-processing treatment, colour grading, and overall editing style — is applied at her sole professional discretion.

The client may not request fundamental changes to the editing style after delivery. This includes requests for all images in black and white, alternative colour treatment, heavy retouching inconsistent with our style, or reverting to an unedited appearance.

Minor adjustments to individual photographs may be requested within 14 days of gallery delivery and will be considered on a case-by-case basis, without obligation.

If the client has specific creative preferences or requirements, these must be communicated in writing prior to the session and are subject to acceptance by the photographer.

Liability

Viktoria Jensen Photography exercises all due care and professional skill in delivering photography services. However, liability is subject to the following limitations.

Viktoria Jensen Photography is not liable for damage, loss, or costs resulting from circumstances beyond her reasonable control, including but not limited to illness, accident, equipment failure, or force majeure.

Total file loss. In the unlikely event of complete or substantial loss of image files due to unforeseen technical failure, the photographer's liability is limited to a full refund of the total amount paid for the relevant assignment. No other compensation will be due.

Maximum liability. In all other cases, the total liability of Viktoria Jensen Photography for any claim arising out of or in connection with an assignment is limited to the total invoice amount of the relevant assignment.

Viktoria Jensen Photography is not liable for any indirect, consequential, or incidental damages, including loss of income, loss of use, or other economic or emotional losses.

Complaints

Viktoria Jensen Photography strives for the highest quality in every assignment. If you are not satisfied with the delivered work, we ask that you contact us promptly so that we can work towards a solution.

Complaints regarding delivered photographs must be submitted in writing to info@viktoriajensen.nl within 14 days of gallery delivery. Complaints submitted after this period will not be processed.

We will acknowledge receipt of your complaint and respond substantively within 14 days. If the complaint is found to be justified and the work does not meet the agreed standard, we will offer a reasonable and proportionate remedy.

If a satisfactory resolution cannot be reached through direct consultation, the matter may be submitted to the competent court in the Netherlands.

Privacy

Viktoria Jensen Photography processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch privacy legislation.

Personal data is collected and used solely to execute the photography assignment and maintain necessary communication with clients. Photographs containing identifiable individuals will only be published publicly with the client's consent, as established through the agreement.

Governing Law

These terms and conditions and all agreements entered into with Viktoria Jensen Photography are governed exclusively by Dutch law.

Any disputes arising from or in connection with an agreement that cannot be resolved through amicable consultation shall be submitted exclusively to the competent court in the district of Groningen, the Netherlands.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced by valid provisions that most closely reflect the intent of the original.
