1.1 These terms and conditions apply to all offers, quotations, services, assignments and agreements between Viktoria Jensen Photography (the “Photographer”) and the client (the “Client”), unless agreed otherwise in writing. 1.2 By accepting a quotation or placing an assignment, the Client agrees to these terms and conditions.
2.1 The Photographer provides photography and related services as described in the quotation and/or assignment confirmation. 2.2 The scope and duration of the services are agreed in advance.
3.1 All prices are stated in euros and include VAT, unless stated otherwise. 3.2 Payment must be made within the period stated on the quotation or invoice. 3.3 Delivery of photos, digital files, USB drives or other products takes place only after full payment of the agreed amount, including any additional work. 3.4 Until full payment has been received, all photos and files remain the property of the Photographer and no usage rights are granted. 3.5 The Photographer reserves the right to suspend delivery in case of late payment.
4.1 If the actual duration or scope of the assignment exceeds what was agreed, this will be considered additional work. 4.2 Additional work will be charged at the Photographer’s communicated or customary hourly rate.
5.1 Cancellation by the Client must be made in writing. 5.2 In case of cancellation within 48 hours prior to the assignment, the Photographer reserves the right to charge costs. 5.3 In case of force majeure (such as illness or extreme weather), the Photographer may reschedule or cancel the assignment.
6.1 Photos are delivered digitally in edited form, unless agreed otherwise. 6.2 The delivery time is generally 2–4 weeks, depending on the scope of the assignment. 6.3 The Photographer is not obliged to provide unedited (RAW) files. 6.4 Any previews or selections are provided for impression purposes only and may contain watermarks and/or be low resolution. 6.5 No rights can be derived from previews. Full-resolution files are delivered only after full payment.
7.1 The Photographer performs the assignment according to her own artistic insight and style, as shown in her portfolio. 7.2 Subjective dissatisfaction with style or taste does not constitute grounds for cancellation, discount or non-payment.
8.1 Copyright of all photos remains with the Photographer. 8.2 After full payment, the Client receives a non-exclusive license for private use. 8.3 Commercial use is only permitted with prior written consent of the Photographer. 8.4 The Photographer may use photos for portfolio and promotional purposes unless agreed otherwise in writing.
9.1 The Photographer’s liability is limited to direct damages and to a maximum of the invoice amount. 9.2 The Photographer is not liable for consequential damages or subjective dissatisfaction.
10.1 Personal data is processed in accordance with applicable privacy legislation. 10.2 Further details can be found in the privacy policy on the website.
11.1 Dutch law applies to all agreements. 11.2 Disputes will be submitted to the competent court in the district of the Photographer.
